Staffing agencies in Norway: New regulations restricting employee leasing

Since the beginning of the year, Novum Økonomi AS has been closely monitoring legislative changes regarding staffing agencies in Norway. The regulations restricting employee leasing, introduced on April 1, have caused significant upheaval among entrepreneurs. The transitional period for companies that had signed employee leasing agreements under the old rules ended on July 1, 2023.


New regulations in Norway: Scope of the employee leasing ban

The new regulations have imposed a total ban on employee leasing in the construction industry in the Oslo, Akershus, Buskerud, Østfold, and Vestfold regions, and significant restrictions on hiring leased employees apply to the rest of the country.

These legislative changes have sparked involvement from representatives of the staffing industry. One of the active advocates of the industry is Heine Aardalen, the owner of a staffing agency that achieved over 200 million NOK in turnover at its peak. Following the introduction of the new regulations, Stolt AS laid off more than 150 people.

Lawsuits against Norway

Heine Aardalen and other entrepreneurs from the staffing industry have filed lawsuits with the District Court in Oslo, demanding the lifting of the ban and leasing restrictions. The case has also been referred to the European Free Trade Association Surveillance Authority (ESA). So far, the Norwegian government has only received support from the German authorities regarding the ban.

The process in the ESA is crucial for the future of regulations concerning employee leasing in Norway. A hearing on this matter is scheduled for June, which will determine the further course of action. A verdict in this case is expected to be announced in October. The ESA decision could have a significant impact on the future of staffing agencies and the situation of leased employees in Norway.
